Data Controller
Paracas Explorer S.A.C., with RUC [RUC] and registered address at Av. Paracas, Mz. D, Lot 9 — El Chaco, Paracas, Ica, Peru, is responsible for processing the personal data you provide to us, in accordance with Law No. 29733, the Personal Data Protection Act, and its implementing regulations approved by Supreme Decree No. 003-2013-JUS.
What Information We Collect
- Identification information: first and last names, ID card or passport, nationality, and date of birth.
- Contact information: email, phone number, and WhatsApp number.
- Reservation details: date of service, number of passengers, accommodations, arrival and departure times.
- Relevant health information: only the information you choose to share with us for your safety during the activity, such as allergies, medical conditions, or pregnancy.
- Browsing data: IP address, device type, and pages visited, collected through cookies.
How We Use Your Data
- Manage, confirm, and process the booked reservation.
- Coordinate transportation, entry into protected areas, and any third-party services required for the tour.
- Issue payment receipts and comply with tax and accounting obligations.
- Handle inquiries, complaints, and requests for information.
- To send marketing communications about our services, only if you have given your prior, free, and informed consent.
Legal Basis
The processing is based on the performance of the tourism services contract, compliance with legal obligations applicable to the agency, and, for commercial communications, the consent you provide.
Who We Share Your Data With
We only share data when it is essential to provide the service: transportation operators, boat operators, lodging providers, protected natural area managers, and payment gateways. Each receives only the information necessary to perform their function.
We may also disclose information to the appropriate authorities when there is a well-founded request in accordance with the law.
Database and Preservation
The data is stored in the agency's customer database. It is retained for the duration of the business relationship and, thereafter, for the periods required by tax, accounting, and consumer protection regulations.
International Transfer
Some of our technology providers (email, web hosting, analytics) may be located outside of Peru. In such cases, we require security and confidentiality guarantees equivalent to those provided for under Peruvian law.
Your Rights
You may exercise your rights of access, rectification, erasure, and objection at any time, as well as your rights to information and to withdraw consent.
To exercise these rights, please email us at reservas@paracasexplorer.com or visit our office, attaching a copy of your ID and the corresponding request. We will respond within the legally required timeframes.
If you believe your rights were not respected, you may file a complaint with the National Authority for the Protection of Personal Data of the Ministry of Justice and Human Rights.
