Paracas Explorer S.A.C. categorically condemns the sexual exploitation of children and adolescents (ESNNA) in the tourism and travel sectors. ESNNA is a crime and a serious violation of human rights.
Our Commitment
As a tourism service provider in Peru, we are committed to preventing, detecting, and reporting any form of sexual exploitation of children and adolescents linked to tourism.
This commitment extends to all our staff, guides, drivers, crew, and vendors, and applies to all the destinations where we operate.
Legal Framework
- Law No. 28251, which amends the Penal Code with regard to crimes against sexual freedom and criminalizes child sex tourism.
- Law No. 29408, the General Tourism Law, which requires tourism service providers to take measures to prevent child sexual exploitation and abuse.
- Law No. 30096 on cybercrimes, as it pertains to making sexual advances to minors via digital media.
- Code of Conduct Against ESNNA, promoted by the Ministry of Foreign Trade and Tourism (Mincetur).
The penalties for these crimes in Peru include long prison sentences, which apply to both nationals and foreigners.
What We Do
- We train our staff to recognize risky situations and know how to respond.
- We inform our passengers about the existence of this code and the applicable penalties.
- We include clauses rejecting ESNNA in our agreements with our suppliers.
- We refuse to provide any services when there are reasonable grounds to believe that a minor is being exploited.
- We report any incident that comes to our attention to the appropriate authority.
What We Expect from Our Passengers
By contracting our services, the passenger agrees not to engage in or facilitate any conduct that constitutes the sexual exploitation of children or adolescents. The agency reserves the right to immediately terminate the service, without the right to a refund, and to report the incident to the authorities.
